Bjorka's Behavior Accelerates The Ratification Of The Pdp Law?
The PDP Law or what we know as the Personal Data Protection Law, which is claimed to contain the protection of citizens' personal data has not yet been enacted. Given that lately there have been many data leakage incidents, one of the culprits is Bjorka. The hacking carried out by Bjorka is reportedly able to accelerate the enactment of the PDP Law, so when will the PDP Law be enforced?
Until now, the PDP Law has not been enacted, but the draft has been passed into law on Tuesday (9/20), this ratification is quite close to the hacking carried out by Bjorka. So there is speculation that Bjorka's leaking of public data accelerated the ratification of the PDP Law. One of the originators of this speculation is Ismail Fahmi as the founder of social media analysis platform Drone Emprit.
"Thanks to Bjorka, the PDP Bill will be passed soon," explained Ismail Fahmi on his Twitter account, Thursday (22/9).
On September 20, the draft PDP Bill had just advanced to Phase II Talks, aka ratification at the DPR Plenary Session. At the meeting, all DPR members present agreed that the PDP Bill should become a law. After being passed, when can the PDP Law be enacted?
Even though it has been passed at the plenary session of the DPR, the PDP Law cannot be enacted immediately, because the PDP Law still has to go through 1 more stage after being approved by the DPR. The PDP Law must still be sent by the DPR to the President no later than 30 days, after which the PDP Law can only be enacted.
According to the Law on the Establishment of Laws and Regulations, a bill becomes a law within 30 days after it is jointly agreed between the DPR and the Government, with or without the President's signature (Article 73 paragraphs (2) and (3)).
The PDP Law is a hope where the PDP Law is considered a good start for the problem of personal data leaks that have hit Indonesia lately. In this PDP Law, there are a number of important points that regulate fines or sanctions for collectors, leakers, and illegal users of personal data.
Not only that, the PDP Law also regulates a substantial fine for corporations that are known to be negligent in maintaining the personal data they manage. In addition, the PDP Law also requires Personal Data controllers, both from the government and private sectors, to notify citizens or customers affected by data leaks, to give citizens the right to withdraw and delete their personal data.
Although the PDP Law is considered a good legal basis for the protection of personal data, there are still activists who criticize it, because according to them this law is more dominant in serving the interests of the government.
